Reporting breaches and abuses

Bergman Engineering sp. z o.o. has a Procedure for reporting breaches and abuses and protecting whistleblowers. The procedure is part of the Code of Conduct and Business Ethics of Bergman Engineering sp. z o.o.

Breach or abuse is any act or omission violating applicable laws, codes, internal regulations, procedures, or intended to circumvent them to the extent specified in Directive (EU) 2019/1937 of the European Parliament and of the Council of 23/10/2019 on the protection of persons who report breaches of Union law.

The procedure should not be used to bypass normal means of reporting or making complaints. Issues regarding current problems related to the work performed or the provision of services should be resolved based on existing reporting relationships or other available channels that should be used for these purposes and are dedicated to these purposes.

We ensure complete confidentiality of all complaints and protection of persons reporting breaches or abuses.


At the same time, we would like to point out that a person who knowingly and intentionally reports false, misleading information or unverified rumors will be subject to sanctions provided for in applicable law. To benefit from protection, the person reporting must be in good faith, i.e. believe that the information and circumstances held are true and act in the public or internal interest of the Company.

Persons who report solely in their own interest, in order to gain personal benefits, are not protected.

In order to limit the number of false or unreliable complaints and slander, the Company will not investigate any anonymous complaints. If a breach or abuse is discovered or suspected, any person may report it in one of the following ways:

1. in electronic form to the email address: naruszenia@bergman-engineering.com assigned directly to the Coordinator with the necessary annotation in the subject line: “Complaint of the Whistleblower to the Management Board of Bergman Engineering sp. z o.o.” or “The whistleblower’s complaint to the Coordinator of Bergman Engineering sp. z o.o. ”

2. in writing by traditional correspondence to the following address: Bergman Engineering sp. z o.o., ul. L. Petrażyckiego 57, 52-434 Wrocław, in a double envelope with the necessary note on the inner envelope: “Complaint of the Whistleblower to the Management Board of Bergman Engineering sp. z o.o.” or “The whistleblower’s complaint to the Coordinator of Bergman Engineering sp. z o.o. ” 

3. At the request of the Complainant, the Complaint may be made during a direct meeting on a date agreed by the Parties. To arrange a meeting, please contact the Coordinator by e-mail at the following e-mail address: naruszenia@bergman-engineering.com

The complaint, regardless of the choice of submission method, should be sent on a specially prepared form and contain all the information required there.

The use of the Complaint form is not obligatory to initiate the breach or abuse investigation procedure, however, if you decide not to use the form template, the complaint should include all the information required therein.
